By purchasing any wine from Excellent Trading co., Inc (www.etcwine.com) you agree that you are bound by the following Terms and Conditions:
Sale of Alcoholic Beverages:
You must be over the age of 21 to purchase alcohol. By using this site and placing an order you guarantee to us that you are at least 21 years of age and warrant that you are legally able to purchase and consume alcoholic beverages.
When your alcoholic beverages are delivered, the person receiving delivery will be required to show identification proving that he or she is at least 21 years old.
If any person under 21 years of age fraudulently orders and has wine shipped to them, the wine will not be released to them, and will be returned to us, and the cost of return shipping will be charged to the responsible party.
Placing an Order:
Orders placed will ship within the next 2 business days. Shipping charges are based on delivery area and package size. Orders placed for shipping Thursday through Sunday are shipped on the following Monday.
BY ORDERING YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE SELLER FOR ANY RESULTING CONSEQUENCE OF A FRAUDULENT ORDER OR ANY MISREPRESENTATION AS TO THE AGE OR LEGAL ABILITY OF ANY INTENDED RECIPIENT TO RECEIVE SHIPMENT OF ALCOHOLIC BEVERAGES.
By placing any order with Excellent Trading co., Inc (www.etcwine.com), you authorize Excellent Trading co., Inc (www.etcwine.com) to act on your behalf to engage a common carrier to deliver your order to your selected destination.
Sales Tax:
All wine is sold in the state of California, and the title passes to the buyer in California.
We must collect a 8.25 % sales tax for all shipments to California.
Shipping Restrictions:
The buyer is solely responsible for the shipment of wine. We make no representations concerning your legal right to ship or receive wine into any state outside California or any country outside the United States.
Some states do not allow the direct shipment of wine. Please consult your local Alcohol Beverage Control board regarding your local and state laws. Excellent Trading co., Inc (www.etcwine.com) makes no claims or representations concerning the laws in other states regarding shipping or importation of wines and all buyers assume all risk with regards to this service.
Shipping:
We always recommend shipping to a business address where someone will be present to receive the shipment during business hours. Signature releases are not accepted. If the shipment is returned to us for an improper or incomplete address we will have to re-charge you for re-shipment, so please make sure the address is complete including business name, department, if any, and suite number if going to a business complex.
We cannot ship to PO, APO, or FPO box offices.
All shipping carriers require an adult signature at the time of delivery. We will not be able to refund any shipping charges if your package comes back to us because there was no adult to sign for the wine!
Availability: Occasionally, demand for limited supplies will deplete our stock of a particular wine. If this is the case, the item will be placed on backorder and we will notify you via e-mail. If you would like to receive the item when it becomes available, your credit card will be charged for the item only when it is shipped.
Extreme Weather: Excellent Trading co., Inc (www.etcwine.com) reserves the right to hold shipment of your wine during extreme weather conditions. Excellent Trading co., Inc (www.etcwine.com) cannot be responsible for damage to wine (including leakage or damaged corks) shipped to you against our express protestations in regards to weather conditions. If the weather is very hot or cold in your area, and you would like us to postpone our shipping, please advise us. We request that all shipping holds do not exceed 30 days from the date of purchase. Please check your local weather before placing your order. We do not advise shipping via ground during temperatures over 80°F (26°C) or under 32°F (0°C). We do not advise shipping during temperatures over 90°F (32°C).
Cancellation of Order: Unless an order is cancelled the same business day on which it is made, it is subject to a 15% restocking fee. Any order that is cancelled that is in transit is subject to the shipping and return shipping charge.
Return:
All requests for returns must be made within 7 days of the invoice date, no exceptions. Please check your order receipt carefully to make sure you ordered the correct wine.
We will not be responsible for any incorrect orders placed by you, the customer.
Any incorrect orders that are processed and shipped will be subject to a 15% restocking fee. The prices for wine can fluctuate greatly from day to day, because of this we do not accept returns for wines based on price changes within the marketplace.
The buyer is responsible for any and all shipping charges for returned items.
All items are sent insured. If you receive an item that has been damaged in shipping you must contact us immediately. You must save all packaging and the broken items for inspection by the insurance adjuster. Without the broken items and original packaging, there is no way to file a claim. If you do not save the items and packaging, we cannot accept returns or file a claim on your behalf.
As is tradition in the wine trade, all bottles 10 years or older are purchased at the buyer's risk, and we cannot be responsible for "corked" bottles.
All wine sold by us is maintained at optimum conditions. We consider wine to be out of our control once it has been handed over to the shipper and we cannot be responsible for improper storage after it has been delivered, and as such we cannot accept returns for the following:
Wines that do not coincide with personal tastes.
Wines that have been adversely affected by customer’s storage.
Any other adverse condition affected while in customer’s care.
Although it rarely happens, we have to state that prices are subject to change without notice. We reserve the right to correct pricing errors.
These Terms and Conditions of Sale, as well as your and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of California. You consent to the exclusive jurisdiction with any wine purchased from us. In no event shall our liability ever exceed the purchase price actually paid by you for such wine.
